By accessing or using EnduranceFinder ("EnduranceFinder," "we," "us," or "our"), including our website at endurancefinder.com and any associated services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

If you are using EnduranceFinder on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you may not access or use our services.

EnduranceFinder is an endurance event discovery and registration platform designed specifically for the endurance sports community, including but not limited to:

• Marathons, half marathons, and road races
• Triathlons, duathlons, and multisport events
• Ultra marathons and trail running races
• Cycling events, gran fondos, and gravel races
• Open water swimming and swimrun events
• Obstacle course races and adventure races

Our platform enables race directors and event organizers ("Organizers") to create, manage, and sell registrations and tickets to events, and allows athletes and attendees ("Athletes" or "Attendees") to discover and register for these events.

Account Creation

To access certain features of EnduranceFinder, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

Age Requirements

You must be at least 18 years old to create an account and use our services. If you are under 18, you may only use EnduranceFinder with the involvement and consent of a parent or legal guardian.

Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any conduct that we determine is harmful to other users or our platform.

Purchasing Registrations & Tickets

When you register for an event or purchase a ticket through EnduranceFinder, you are entering into a transaction with the race director or event Organizer. EnduranceFinder acts as an intermediary platform facilitating this transaction.

Pricing and Fees

All registration and ticket prices are set by the race director or event Organizer. EnduranceFinder may charge service fees, which will be clearly displayed before you complete your purchase. All fees are non-refundable unless otherwise stated.

Payment Processing

Payments are processed through our secure third-party payment processors. By making a purchase, you authorize us to charge your selected payment method for the total amount of your order, including any applicable taxes and fees.

Confirmation & Ticket Delivery

Registration confirmations and tickets are delivered electronically to the email address associated with your account. You are responsible for ensuring your email address is correct and for checking your spam folder if you do not receive your confirmation.

Race Director & Organizer Responsibilities

If you use EnduranceFinder as a race director or event Organizer, you agree to:

• Provide accurate and complete event information
• Honor all registrations and tickets sold through our platform
• Comply with all applicable laws and regulations
• Maintain appropriate insurance for your events
• Handle athlete and attendee data in accordance with privacy laws
• Communicate event changes or cancellations promptly
• Process refunds in accordance with your stated refund policy

Race Director & Organizer Fees

Race directors and organizers agree to EnduranceFinder's fee structure as outlined in our pricing documentation. Fees are deducted from registration and ticket sales before payout, unless otherwise arranged.

Payouts

Race directors and organizers will receive payouts according to our standard payout schedule. EnduranceFinder reserves the right to withhold payouts in cases of suspected fraud, chargebacks, or Terms violations.

Event Content

Race directors and organizers are solely responsible for their event content, including descriptions, images, and any materials presented at their events. Content must not violate any laws, infringe on intellectual property rights, or contain harmful or misleading information.

Race Director & Organizer Refund Policies

Each race director or event Organizer sets their own refund policy, which is displayed on the event page. By registering for an event or purchasing a ticket, you agree to the Organizer's stated refund policy.

Event Cancellations

If an event is cancelled by the Organizer, athletes and attendees are entitled to a full refund of the registration or ticket price. EnduranceFinder service fees may or may not be refunded depending on the circumstances of the cancellation.

Event Postponements

If an event is postponed to a new date, your registration or ticket will typically be valid for the new date. If you cannot attend the new date, refund availability is subject to the Organizer's policy.

Requesting Refunds

Refund requests should be directed to the race director or event Organizer. EnduranceFinder can assist in facilitating communication but is not responsible for Organizer refund decisions outside of cancellations.

When using EnduranceFinder, you agree not to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Post false, misleading, or fraudulent content
• Attempt to gain unauthorized access to our systems
• Use automated systems to access our platform without permission
• Interfere with the proper functioning of our services
• Engage in ticket scalping or unauthorized resale
• Harass, abuse, or harm other users
• Use our platform for any illegal purposes
• Impersonate another person or entity

EnduranceFinder Content

The EnduranceFinder platform, including its design, features, code, and content, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

User Content

You retain ownership of content you submit to EnduranceFinder. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content in connection with our services.

Copyright Complaints

If you believe content on EnduranceFinder infringes your copyright, please contact us with the details. We will respond to valid copyright complaints in accordance with applicable law.

Platform Provided "As Is"

EnduranceFinder is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Damages

To the maximum extent permitted by law, EnduranceFinder shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of our services.

Maximum Liability

Our total liability to you for any claims arising from these Terms or your use of EnduranceFinder shall not exceed the amount you paid to EnduranceFinder in the twelve (12) months preceding the claim.

Event Disclaimer

EnduranceFinder is not responsible for the quality, safety, or legality of events listed on our platform. We do not endorse any Organizer or event and are not liable for any injury, loss, or damage that occurs at or in connection with any event.

Informal Resolution

Before filing a formal dispute, you agree to contact us and attempt to resolve any dispute informally. We will try to resolve disputes through good-faith negotiations.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in Los Angeles County, California.

Class Action Waiver

You agree to resolve disputes with EnduranceFinder on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

We may update these Terms from time to time. When we make material changes, we will notify you by email or through a notice on our platform. Your continued use of EnduranceFinder after changes become effective constitutes acceptance of the new Terms.
